A Possession Charge for Heroin is charged when
only personal use is alleged by the state.
Generally a possession charge for heroin will be
imposed when the actor has from a dusting up to
1/2 oz in his possession. But the weight of the
heroin alone is not the only factor the police will
look at when charging you. Even if you have less
than 1/2 ounce if the heroin was packaged as 10
packets and you had a scale or large sums of
money in your possession, you may be charged
with both heroin possession and distribution. The
State does not need to prove actual possession of
the heroin on your person, but merely constructive

A Distribution Charge for Heroin: Requires the actor
to possess a quantity of heroin over 1/2 ounce. You
can still however be charged with distribution of
heroin even for less than 1/2 oz if the circumstances

person to believe that your intentions were to sell or
give heroin to other people. Distribution of heroin is
a very serious charge and has similar penalties in the
